Terms of Service & EULA

These Terms of Service and End User License Agreement (the "Terms" or "EULA") govern the use of the video game Breaking Shot! (the "App" or "Game"), published by [[RAGIONE_SOCIALE_O_NOMINATIVO_LEGALE]] ("we" or the "Licensor"). By downloading, installing or using the App, you (the "User") fully accept these Terms. If you do not accept the Terms, do not install or use the App.

The Licensor grants the User a personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App on compatible devices owned or controlled by the User, exclusively for personal, non-commercial use, subject to Google Play conditions and these Terms.

The App, including code, graphics, audio, music, text, trademarks, logos and any other content, is the exclusive property of the Licensor or its licensors and is protected by copyright, trademark and intellectual property laws. No ownership right is transferred to you; only the licence described in section 1 is granted.

4. Updates and availability

The Licensor may release updates, patches and new versions of the App, including to fix bugs, improve performance or introduce features. Failing to update may cause malfunctions or prevent the use of the App. The Licensor does not guarantee uninterrupted availability of the service and reserves the right, at its discretion, to suspend, modify or discontinue the App or its features, even without prior notice.

5. User conduct

The User is solely responsible for the use of the App and for any content the User may share where available. Use of the App to harass other users or distribute illegal, offensive or rights-infringing content is prohibited. The Licensor reserves the right, where technically possible and necessary, to restrict access to anyone violating these Terms.

6. Privacy

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

7. Warranty disclaimer and limitation of liability

The App is provided "as is" and "as available", without express or implied warranties, except those mandatorily required by applicable law. To the maximum extent permitted by law, the Licensor shall not be liable for indirect, incidental, special or consequential damages arising from use or inability to use the App. Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence or the consumer's legal warranty of conformity.

8. Termination

These Terms remain in force as long as the User uses the App. The licence terminates automatically upon material breach of the Terms by the User. Following termination, the User must cease use and uninstall the App.

9. Changes to the Terms

The Licensor may modify these Terms for operational, regulatory or security reasons. The updated version will be published on this page with a new effective date. Continued use of the App after publication constitutes acceptance of the changes.

10. Governing law and jurisdiction

These Terms are governed by the laws of Italy. Any dispute is subject to the jurisdiction of the consumer's place of residence, where applicable; failing that, the courts of [[COMPETENT_VENUE]] shall have jurisdiction. The consumer's right, where applicable, to bring proceedings before the authorities of his/her EU State of residence remains unaffected.
